China's Decision to Strengthen Export Control of Dual-Use Items to the U.S.

In accordance with the relevant provisions of the "Export Control Law of the People's Republic of China" and other laws and regulations, and to safeguard national security and interests, as well as fulfill international non-proliferation obligations, China has decided to strengthen the export control of related dual-use items to the United States. The following matters are hereby announced:

1. The export of dual-use items to U.S. military users or for military purposes is prohibited.

2. Exports of gallium, germanium, antimony, superhard materials, and related dual-use items to the U.S. will generally not be permitted. For graphite dual-use items, stricter end-user and end-use reviews will be implemented for exports to the U.S.

Any organization or individual in any country or region who violates these provisions, by transferring or providing related dual-use items originating from the People's Republic of China to U.S. organizations or individuals, will be held legally accountable.

This announcement will come into effect immediately upon publication.

Q: We noticed the Ministry of Commerce's announcement on strengthening export control of dual-use items to the U.S. What is the rationale behind this decision?

A: In recent years, the U.S. has generalized the concept of national security, politicized and weaponized economic and technological issues, and misused export control measures to arbitrarily restrict exports of relevant products to China. The U.S. has also placed multiple Chinese companies on sanction lists, severely undermining international trade rules, damaging the legitimate rights and interests of businesses, and destabilizing global industrial and supply chains.

To protect national security and interests, and to fulfill non-proliferation obligations, China has decided to strengthen export control of relevant dual-use items to the U.S. This includes prohibiting the export of dual-use items to U.S. military users or for military purposes, and strictly controlling the export of gallium, germanium, antimony, superhard materials, and graphite-related dual-use items to the U.S. Any organization or individual who violates these regulations will be held legally responsible.

The Chinese government remains committed to advancing high-level opening-up and firmly opposes the improper practice of generalizing national security concerns. China is willing to strengthen dialogue with relevant countries and regions in the field of export controls to jointly promote the safety and stability of global industrial and supply chains.
